Welcome to Poolspacy.

These Terms of Service ("Terms") apply to the use of the Poolspacy website and to purchases made through our online store.

The website and online store are operated by POLIIT POOLS AND SPA LTD, a company registered in Cyprus. Shopify provides the technology and platform that enables us to operate our online store.

By accessing our website, browsing our store or placing an order, you agree to these Terms of Service and the policies referenced in them, including our Privacy Policy, Shipping Policy and Returns & Refund Policy.

Nothing in these Terms is intended to limit or exclude any mandatory consumer rights applicable under the laws of the Republic of Cyprus or the European Union.

SECTION 1 – ACCESS AND ACCOUNT

You must be legally capable of entering into a contract under applicable law to make a purchase through our store.

When placing an order, you agree to provide accurate and complete information, including your name, email address, billing information, payment information and delivery address.

You are responsible for ensuring that the information provided is accurate and up to date.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, images and other information displayed on our website are accurate.

Colours and appearance may vary slightly depending on your device, screen settings and other factors.

Product specifications, availability and images may be updated from time to time. Where a product specification is important to the customer's intended application, we recommend confirming the relevant technical information with us before placing an order.

Some products are available as standard products, while others may be available by special order, made to order or according to customer specifications.

SECTION 3 – ORDERS

When you place an order through our website, you submit a request to purchase the selected products.

An order becomes binding when we confirm its acceptance, subject to applicable law.

We reserve the right to refuse or cancel an order in circumstances including:

• the product being unavailable;

• an obvious pricing or product description error;

• an inability to deliver to the requested destination;

• payment not being successfully completed; or

• other circumstances that make fulfilment impossible.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

Your purchases are subject to our Returns & Refund Policy and applicable statutory consumer rights.

SECTION 4 – PRICES AND PAYMENT

All prices displayed on our website are in EUR (€).

Unless otherwise stated, prices displayed to consumers in Cyprus include applicable VAT.

Delivery charges and other additional costs will be communicated before the order is completed where they are not already included in the displayed price.

Prices, discounts and promotions may change from time to time. Any price applicable to an accepted order will be confirmed in the order confirmation.

For custom, special-order or project-based products, we may require an advance payment or deposit. Any such payment and the applicable terms will be communicated to the customer before the order is confirmed.

SECTION 5 – SHIPPING AND DELIVERY

We deliver within Cyprus through local delivery by Poolspacy, third-party courier services or other suitable transportation providers.

Local pickup may also be available.

For deliveries outside Cyprus, suitable products may be shipped using international courier services such as DHL or UPS.

Delivery times are estimates and may vary depending on product availability, order size, destination, transportation and circumstances beyond our reasonable control.

Large, heavy, fragile or special-order products may require individual delivery arrangements and additional delivery charges.

Nothing in these Terms limits any mandatory consumer rights relating to delivery or the transfer of risk under applicable law.

SECTION 6 – INTELLECTUAL PROPERTY

The content of our website, including text, photographs, graphics, logos, product descriptions, designs and other materials, is owned by or licensed to POLIIT POOLS AND SPA LTD or the respective rights holders.

You may not reproduce, distribute, modify or commercially use our content without prior written permission, except where permitted by law.

Third-party trademarks, brands and product names remain the property of their respective owners.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Poolspacy is powered by Shopify, which provides the ecommerce platform used to operate our online store.

Any purchase made through our store is a transaction between the customer and POLIIT POOLS AND SPA LTD.

Shopify is not the seller of the products offered by Poolspacy and is not responsible for the products, fulfilment, delivery or customer service relating to purchases made from Poolspacy, except where applicable under law.

SECTION 10 – PRIVACY

Personal information collected through our website is processed in accordance with our Privacy Policy.

Because our online store is hosted on Shopify, certain personal information may also be processed by Shopify and other service providers as necessary to operate the store, process payments, fulfil orders and provide related services.

SECTION 11 – CUSTOMER REVIEWS AND FEEDBACK

If you submit a review, photograph, comment, testimonial or other feedback to us, you confirm that you have the right to provide that content.

By submitting such content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it for the purposes of operating and promoting our business and website.

We may remove content that is unlawful, misleading, defamatory, offensive or infringes the rights of another person.

SECTION 12 – ERRORS AND INACCURACIES

We make reasonable efforts to keep the information on our website accurate.

Some Poolspacy products may be custom-made, personalised, specially ordered or prepared according to customer specifications.

• bespoke sauna products;

• custom sauna materials;

• wood products cut to requested dimensions;

• personalised products;

• special-order equipment;

• made-to-order products; and

• bespoke sauna and wellness solutions.

Where permitted by applicable law, custom-made, personalised or made-to-order products may be excluded from the statutory right of withdrawal.

Any applicable restrictions will be communicated to the customer before the order is confirmed.

SECTION 15 – WARRANTIES AND STATUTORY RIGHTS

Products may be covered by a manufacturer's commercial warranty where applicable.

Such warranties are subject to the manufacturer's terms.

In addition, consumers retain all mandatory statutory rights relating to defective or non-conforming products.

Nothing in these Terms excludes or limits any consumer guarantee, warranty or other protection that cannot legally be excluded or limited.

Under applicable EU consumer protection rules, consumers have statutory protection in relation to defective or non-conforming goods.

SECTION 16 – DISCLAIMER

We make reasonable efforts to ensure that the information provided through our website is accurate and useful.

However, we do not guarantee that the website will always be available, uninterrupted or error-free.

Product information should be considered together with the manufacturer's technical documentation where applicable.

Nothing in these Terms excludes or limits liability or statutory rights where such exclusion or limitation is prohibited by applicable law.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, we are not responsible for losses resulting from improper installation, misuse, unauthorised modification or use of a product contrary to the manufacturer's instructions.

This does not affect any mandatory rights or remedies available to consumers under applicable Cyprus or European Union law.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

SECTION 18 – FORCE MAJEURE

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, transport disruptions, strikes, supplier delays, customs procedures, government actions or other unforeseen events.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

SECTION 20 – ENTIRE AGREEMENT

These Terms, together with the policies referenced in them, constitute the terms applicable to your use of our website and purchases made through our online store, subject to any mandatory rights provided by law.

SECTION 21 – ASSIGNMENT

You may not transfer your contractual rights or obligations to another person where such transfer is prohibited by applicable law.

We may transfer our rights and obligations where permitted by law.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of the Republic of Cyprus, subject to mandatory consumer protection rights applicable under European Union law.

Nothing in these Terms prevents a consumer from exercising any mandatory rights available under applicable law.

We may update these Terms from time to time.

The version published on our website at the time an order is accepted will generally apply to that transaction, subject to any mandatory legal requirements.
